Anwar wants offending remark removed from Federal Court judgement

PUTRAJAYA: Opposition leader Datuk Seri Anwar Ibrahim is attempting to remove a remark in a Federal Court judgment which implies he has homosexual tendencies.

Anwar filed a review application at the apex court, which is scheduled to be heard on Nov 13.

His lawyer, Karpal Singh, informed the Court of Appeal of the pending review application when he applied to recuse judge Justice Tengku Maimun Tuan Mat from being in the coram to hear the prosecution's appeal against the Opposition leader's acquittal over a sodomy charge.

Justice Tengku Maimun had adopted the remarks from the Federal Court judgment when she dismissed Anwar's defamation suit against former Prime Minister Tun Dr Mahathir Mohamad on July 9, 2007.

Justice Tengku Maimun had stated that "there is in existence a judicial finding that the plaintiff (Anwar) had indeed taken part in homosexual acts".

When contacted, Anwar's lawyer Latheefa Koya said Anwar filed the review application to clear his name.

"eople are using it to justify slander against him. When Anwar wants sue them for defamation, they will rely on this judgment," she said.

She said it should be noted that the remark was incorporated in a judgment acquitting Anwar's of sodomy charges.

In the Federal Court judgement for the acquittal of Anwar over the charge of sodomising Azizan Abu Bakar (Sodomy I) in 2004, the apex court judge had included a remark that; "We find evidence to confirm that the appellants (Anwar and Sukma Darmawan Sasmitaat Madja) were involved in homosexual activities, and we are more inclined to believe that the alleged incident at Tivoli Villa did happen...".
